Legal Question in Civil Litigation in South Carolina

Collecting money owed

I have a 3-part problem with one person - who is now 20 years of age.

1.) When he was 17 I co-signed for a cell phone for him. He ran up over $1500 in 2 months time, which I have had to pay. He has promised to re-pay me but of course, has not.

2.) He stole my debit card out of my purse, obtained by PIN # and stole appr. $510 out of my account over a period of time - he put the card back in my purse after each use so I was not aware right away. He was 18 at the time and has admitted doing this to me and to others.

3.) He borrowed my car and wrecked it - it was ''totaled' by the insurance company. Being in negative equity, I did not receive the full pay-off amount for the car which resulted in having to pay over $2500 for this car plus the cost of purchasing a new car.

At this point, is there any legal action I can take against him for any (or all) of these incidents? He has now left South Carolina and is living in New York.

Re: Collecting money owed

1.) There is not much than can be done with the cell phone. 2.) Stealing your debit card is a crime and you can call the police and ask that they take a warrant out for his arrest. If he is convicted, then you may appear in court at his sentencing and ask that he be ordered to pay you restitution. 3.) You can file a law suit against him for any amount you are owed after the insurance settlement. Good luck.
