damage to adjacent property

A leaking water heater in a condo unit above mine caused water damage ($2500). Insurance company for the owner claims it is an act of god and consequently not covered. Local lawyer says he's not sure whether they're liable. Is this a viable small claims case.

It sounds like it. In SC you can sue someone in Magistrates Court for up to $7,500.00.
