Legal Question in Civil Litigation in South Carolina

My husband is in the middle of a workmans comp case. He was hit as a pedestrian while cleaning up a wreck. Can he sue the individual in a civil case and how long does he have to file?

First of all, I appologize if its taken a few days for me to answer your question. I answer them as soon as I get them, but the site has a delay before sending them out to attorneys.

There are two possible statutue of limitations and since I don't know much about your case I do not know which one applies. One is up in two years and the other is three. That is based on South Carolina of course.

As far as suing an individual, its entirely possible. I would need to ask you a few questions to be sure. There are a lot of instances where you can sue someone individually along with your workers comp. claim. I've done it for clients numerous times.
