Legal Question in Civil Litigation in South Carolina

injury

My mom was injured when she tripped and fell in a retail store. She rounded a corner and a big plastic container was in the middle of the floor. Her injury required 16 stitches. The store has done nothing yet. I went there to speak to the manager who assured me that the bills would be taken care of. My question is...should the hospital go ahead and bill medicare, or bill it as self pay and give the bills to the store? also, should we contact an attorney?

Re: injury

You can handle the bills any way that is convenient, just being careful that you don't let the bills go into collection. The smartest thing would be to get an attorney and let the store's insurance company pay the bills as they become due. The reason that you need an attorney is that the store's insurance company will never take you seriously nor be fair because they know that you do not have the ability to file a law suit. With an attorney they will know that you mean business and will take it serious. Mind if I ask what county this is in? [email protected] Robert Johnston
