Legal Question in Civil Litigation in South Carolina

In Novemmber 2009, a gentleman agreed to do some work on, as well as paint my classic car. It was to be done and ready for pick up in December 2009. He had some trouble with the paint and had to retain the car in order to repaint it. The final date for pick up has come and gone several times since then, and I still don't have my car. He refuses to answer his phone, and also refuses to contact me. Do these actions constitute Breach of Trust in South Carolina?
