How can a judge drop the plaintiffs case before the case is heard by the jury for lack of evidence and proceed with the defendants counter claim?

Its kind of hard to answer your question without know what type of case it is and what transpired on the case. I am assuming its some sort of a civil case since you mentioned, "counter claim." There are a number of ways that a judge can dismiss a civil case. One of the most common is called a Summary Judgment.
