Legal Question in Civil Litigation in South Carolina

reimbursement for damaged vehicle

A minor took my car and was involved in a hit and run accident. My car was badly damaged. The minor went to jail for 45 days. He has continued to deny driving the car even though there were witnesses. His parents have refused to pay for the damages to my car. I plan to take them to small claims court. I do not know how to figure the charges of the car. I have paid $1300.00 for used parts and $405.00 for towing. I wanted the car to look like it did prior to being damaged. The car was a 1998 Nissan Quest van and I had the title so I did not have collision insurance. Their insurance company has refused to pay for damages because he took the car without my permission and because they do not have collision insurance.

Re: reimbursement for damaged vehicle

You didn't say what he went to jail for. It would be helpful to know. It might even assist you you being reimbursed. The best thing to do would to have had the damage estimated by a professional in writing, but it doens't sound like you did that. If not, you will have to use whatever documentation you have, which so far it appears to be the parts bill and the towing bill. You may also be able to seek Loss of Use, Depreciation and money for your time in fixing it. As with all questions posted here, I recommend you have a one-on-one conversation with an attorney to be sure of everything. Good luck.
