Verbal agreement with rental lease

We had a verbal agreement with a

random roommate for a lease. She

mailed us a check for her part of the

deposit and rent, but put a hold on

the check and backed out on us after

we signed the lease. Can we hold

her to that payment in small claims

court?

Your question is a little confusing. I have no idea what a "random roommate" is. But that's okay. It probably doesn't matter. If she signed a lease like you said agreeing to pay you a certain amount of money, and then did not pay that amount of money, then based on what you have told me it appears that she is in breach of the agreement and therefore, you would be able to sue her. However, without having seen the lease and knowing everything else about this situation I cannot say for sure. I would prefer not to guess. See the lease would be key
