Re: Immigration services
Provided you are a United States Citizen and if she entered the United States without inspection, she must return to her country of origin for consular processing. Because she has remained in the United States for more than 1 year, she faces a ten year bar to re-entry and will have to apply for an I-601 waiver, along with your spousal sponsorhsip. Please note that the I-601 waivers are based on extreme hardship to USC spouse and may not be granted in which case the two of you would face a ten year seperation [unless you move to her country of origin also]. Please consult an Immigration Attorney prior to submitting any petition.
