Legal Question in Immigration Law in South Carolina

K1 visa

Hi. A person after obtaining a K1 visa and entering into the US realizes that her fiance drinks and smokes excessively so they call off the wedding. My question is: can this person apply for a permanant visa from inside the US? She has a sister who is a US citizen and lives in US and also has a mother who has a greencard but does not live in US. And if she can, what are the ways and chances that she can apply whitin 90 days?

Hi,

Unfortunately, she can't change status to any visa after entering on the K1. I would have her leave the country and try to make a plan for alternative sponsorship via relatives or other means.
