Auto insurance cancellation notice
I have had auto insurance with a local insurance company for 6 years (four auto's).(I also have my home owners with them.) I have mailed my six
month premium payments by check each time. I was rear ended on 11/28/2006. The person that rear ended me was found at fault. He had no insurance. My premium was renewed on 11/6/2006. I mailed the check as usual. When I called my agent to tell him the problem on the 30th he said my insurance was cancelled because they never recieved payment.
I have showed them a copy carbon copy of the check and other checks that have been written since, but they have denied my claim. I never recieved a cancellation notice. When I was told they never recieved the check I went to the office and wrote another check. I have never
let my insurance collapse. The other check is still missing. I have the post office looking for the check. My question: Is the insurance company required to notify me that my insurance is cancelled? When? How long?
Please help, I have a truck that is a total loss, medical bills, have missed work and it looks as if I am the big loser and it is no fault of mine.

Yes, they are required to notify you. I am going to suggest you contact the Department of Insurance in Columbia. They can be a wonderful source and are in the business of regulating insurance companies. It sounds like you have not been treated fairly. If you do not get any results from them, then by all means contact an attorney. If you can resolve this with the Insurance Commission without paying legal fees then that might be the best way to go.
