Auto Insurance Payouts

I was in an accident in Rock Hill, SC in which the woman who hit me did not have enough insurance to pay for the damages to my vehicle. I dont have collision or underinsured coverage on my insurance so my insurance company refuses to help me. The insurance company for the woman who hit me told me they would issue a check for the repairs, but only if I signed a release stating I would not sue the woman for the balance. How is this leagle?

Yes it is legal. Understand that once you sign a release, then its over. You cannot come back later and ask for more money. You didn't say if you were injured in your question. If you were injured you need to be sure that the release doesn't include your injuries. DO NOT sign anything without consulting with an attorney who can go over the whole claim with you and review the release.
