Legal Question in Insurance Law in South Carolina

Cancelling Health Coverage

My husband is a member of the Air National Guard, and has recently come off of active duty status. While deployed, his current employer placed a hold on his heath coverage, and we did not pay any premiums for this time. During this time, we also found out about the military insurance that is available for guard members. It is much better coverage and much less expensive. His current employer is telling him that he cannot drop his current coverage so that we can be covered by the military insurance. They renewed their policy while he was deployed, and they renewed showing that he accepted the insurance. Were there not the military insurance available, there would be no issue. However, the employer is stating that he can't make any changes to his policy until October 2009. Does he not have the right to choose the health coverage for our family? Are we ''locked in'' to this coverage?

Re: Cancelling Health Coverage

Buying health care coverage from an insurance company is like a contract. Everything must be in writing. Why don't you get a copy of the policy and its terms and better yet, call the insurance company yourself and don't take the employer's word for it.
