Car totaled - still owe

My girlfriend was involved in an accident with my car. She was not at fault. My car is totaled and I have been offered blue book value from the other person's insurance company. The problem is that it does not cover the total loan I have left to pay. Am I liable for the difference? I have no car for my job and I still owe money plus, I don't have the money to buy a new car.

The loan agreement you have with your bank and the insurance policy are separate from each other. You are responsible for the loan regardless of what the insurance company pays you for your car. Sometimes its possible to get more than blue book value from the insurance company. I would advise you to call an attorney and let him/her ask you some questions to see if there is anything that can be done. Good luck.
