Legal Question in Insurance Law in South Carolina
Discrimnation by Insurance company
I was diagnosed with HIV in 2/01. A life insurance policy was taken out in 8/01 with the full knowledge of the diagnosis. After missing a payment, insurance company had me fill out a health questionaire. On it I was asked if I had been diagnosed with anything in the last 5 years, even though it had been 7 years I put down the HIV diagnosis. They are now denialing my insurance, I have asked for a reason and was told over the phone that it was the HIV diagnosis which was told when insurance was first issued. I have also asked for denial in writing which I haven't received and its been almost 3 months. I need to know what I can do now. They took my money for 7 years and then dropped my policy.

Re: Discrimnation by Insurance company
First of all, I do my best to help people with their legal questions, but I have to tell you up front that this is not my area of expertise. I would certainly follow up with this if I was you.
You need to get a copy of the paperwork from when you first informed them of the HIV Virus and show it to them. I can't imagine that they would deny you after you disclosed to them in writing that you had it.
If you still can't get it resolved, then take all of your insurance documents to an attorney.
Good luck
