My car was totaled by another driver, their insurance company is offering less money than my car is worth, what can I do?

That's a tough one. Usually the insurance company will do that. You can try getting copies of Blue Book values and sending them to them and telling them that you will sue them if they don't give you a fair price. If that doesn't work, then you have the right to file a law suit. Most people don't want to do that since it can take a long time for it to come to court and in the meantime your car has not been replaced. I represent a lot of people in car accidents in South Carolina and when a person is injured, we usually use that injury as leverage to get the settlement up on the value of the car. But when its just property damage, it can be very difficult to deal with the insurance company. They just don't deal fair all of the time. I suppose that all you can do is keep negotiating with them, threaten to sue them, or actually file a law suit.
