Legal Question in Insurance Law in South Carolina
Insurance Cancellation Mistake
A company that I have car insurance with cancelled my policy. They admitted that they made a mistake because my insurance is paid up. I was recently arrested for a suspended licence and my 18 wheeler truck was inpounded. Now,as a result of their negligence, I'm out of about $2000. I called them, they said that they were going to refund my money. They then called back and said they wasn't because the DMV sent out a letter with a form for me to give to the insurance company to fill out to sent back to the DMV. I did receive this letter a while back but at the time didn't realize that it had a form on the back for me to give to the insurance co. to fill out. So, now they're saying that I have to eat the $2000. Do you think there is any chance of me getting any of my money, atleast half if not all; because even though I failed to see the form on back of the letter my insurance co. should not have cancelled my insurance in the first place.
Thanks,
Michael Davis

Re: Insurance Cancellation Mistake
You may be able to sue them, but should have an attorney review all the paperwork first. You can also consult with and file a complaint against them through the South Carolina Insurance Commission.
