Legal Question in Insurance Law in South Carolina
negotiating a settlement
I secured legal help (a bad faith attorney) 1 year after trying to settle a claim on my homeowners policy. My lawyer filed a bad faith lawsuit, the judge ruled that it wasn't, but that the insuror did have to pay me the rest of my claim (with some limitations). This ruling was done this year, my lawyer tells me that they're negotiating. By South Carolina statutes, how long does the insuror get to wait before settling? They have made this whole thing absolutely grueling, I have a feeling that they'll wait as long as they can. In just a few months, it will 8 years since it all began. Thank you.

Re: negotiating a settlement
Sorry, but I am unable to answer your question without more information. On one hand it appears that there was a court order requiring the insurance company to pay, on the other hand you said that they are negotiating. May I suggest you have a conversation with your attorney, who should be in the best position to answer your questions. Good luck.
