Rear End Collission

while driving on Hwy278 in Hilton Head, SC an SUV suddenly came from the right lane and broke in to our lane just in front of me (perhaps 15-20 feet), then immediately slammed on the brakes, trying to make a left turn. I tried to stop but had insufficient time and distance to do so, rear-ending his SUV. There were no injuries, not damage to his SUV but my car was damaged beyond repair. The SUV driver was cited but now disputes the claim. What should I do?

You need to talk to an attorney right away. If he disputes the ticket now, he may file suit against you in the meantime, and successfully dispute the liability. Give our offices a call.

You did not provide any details as to what you meant by the other driver, "disputes the claim." Without knowing that it is hard to advise you. Does that mean that you have personally contacted him and he won't pay you? Does that mean that his insurance company is denying the claim? Does this mean that there is a law suit? Normally, all you have to do is turn this over to your insurance company and they handle it for you. I assume that you have already done that. If so, then I would suggest calling and asking your insurance company. On a side note, if you received a Financial Responsibily form from the Police, also called and FR-10, then you are required by law to turn that over to your insurance company.
