Legal Question in Insurance Law in South Carolina
Reimbursement to health insurance?
I was involved in a car accidnet. I was not at fault. My health insurance paid my med bills. I settled with the other drivers insurance but she did not have enough insurance to cover pain and suffering, lost work, or the future surgeries that I will require. I have not been able to work in 4 yrs and have had 6 surgeries so far. My former health insurance wants reimbursement of the money they paid for my med bills. I argue that I paid to have the coverage and they would have had to pay for it if she were uninsured. I have lost thousands upon thousands of dollars due to this wreck and can no longer work at all. Am I legally obligated to repay my former health insurance? Can they sue me for the money?
thank you in advance for any advise.

Re: Reimbursement to health insurance?
You need to either review in carefull detail your insurance policy which will spell out all obligations of both you and the insurance company, or, better yet, have an attorney review it. A policy is basically a contract, and all contracts govern what is obligated by the contracting parties. Good luck.
