Legal Question in Insurance Law in South Carolina

Reimbursing the Insurance Company

I was in a head on collision due to no fault of my own. The man was charged with driving left of the yellow line. I have health insurance from my place of employment that I have been filing Doctors visits and medical expenses on. My question is,Do I have to reimburse the Insurance Company after I settle?

Re: Reimbursing the Insurance Company

Normally, your health insurance company has what is called subrogation rights to your claim against the at-fault driver. If you read your policy, you should find a clause in your policy disussing this issue. This normally requires you to reimburse your health insurance carrier for the amounts paid by them. You may be entitled to offset some of this claim for attorney fees, etc. Also, if your medical expenses exceed the insurance coverage you may be able to negociate with your health insurance carrier regarding how much they should be reimbursed. If you would like to discuss this further, you may contact me at 1-864-231-8870.
