Legal Question in Insurance Law in South Carolina

A tree fell on my dads house during a storm. I tried to help him remove the tree and fell off the house through the roof and broke my elbow. We had part of the tree attached to a chain that was attached to a truck. The insurance company is saying that because the truck was involved the claim goes though the automobile insurance; but I fell off the house. The home and car insurance is under the same company, should the case really be though the automobile and not the home?

Automobile policies are a lot easier to predict than homeowner policies. Often I can give specific advise about an auto policy without seeing it. However, with owner policies, it often becomes necessary to review the policy in order to advise. That is the case with your particular situation. Without seeing the homeowner policy I cannot tell you if the insurance company is correct or not. At this point I'm wondering which policy would be in your best interest. It would be interesting to know what differences there might be between the deductable, medical coverage, etc. It would seem to me that the homeowner policy should apply, even though a car was involved. But again, it would be necessary to actually see the policy.
