Crimes ruled an accident

My brother was sitting in his living room playing a video game when his neighbor's gun went off from inside of the neighbor's house which is a couple of feet away and shoot my brother in the head. Now my brother is left with all the bills while the neighbor goes on to live his life. Shouldn't this neighbor be responsible for all the hospital bills and some kind of pain and suffering?

Was this a homeowner or renter?

Possible coverage by HO insurance. Otherwise he may have assets to attach.
