refund of security deposit

We signed a post dated lease for a house and paid a security deposit to the landlord. For numerous reasons we are unable to move into the property and notified the landlord of thisbefore the lease began. We asked for the security deposit back and he said he didn't know if we were entitled to it back. Does he have to refund the deposit? We never lived in the house or even received keys to the house.

Re: refund of security deposit

If it can't be rented right away (for the period you agreed to ) you may be on the hook for damages due to your breach of lease.

You should offer to pay advertising expense + sign etc. to mitigate the LL's loss.
