Legal Question in Medical Malpractice in South Carolina
Out of state Medical malpractice
I would like to find out if my mother's medical treatment subsequent death were appropriately handled. Many questions arose which were not sufficiently answered. She resided and received medical treatment in South Carolina. I live in Colorado. I have received copies of her medical records from the hospital in SC, which I would like to have reviewed by an independent medical professional. The lawyer I spoke with in Colorado seemed disinterested, suggested I contact a SC lawyer. Must I go to South Carolina to pursue this, or is it appropriate to expect that I can find a lawyer to handle it from Colorado?

Dear Sir/Madam:No you don't have to go to SC. I am a NY lawyer who does practice out ofstate at times. The CO attorney, if not a member of the SC bar would haveto file a Pro Hac Vice application which would enable him to practicebefore the SC courts for the limited purpose of your med. mal. action. Some advice, while it is equally important to find an enthusiastic lawyer,you should speak to a medical professional regarding your potential claim. Have you? What did they say? Is there med. mal.? Wouldn't this be awrongful death action as well? Good luck.
