unnecessary surgery

My wife had a laproscopically aided hysterectomy based on a diagnosis of endometriosis causing chronic pain. This same diagnosis had been ruled out by the same doctor a little more than a year earlier when he found no evidence of the endometriosis. The doctor convinced my wife that there were no alternative treatments for the alleged endometriosis that was probably causing her pain.

During the surgery the doctor penetrated the uterus wall and severed one of my wife�s arteries and damaged a nerve cluster in her hip. The attending staff were unaware of the severe bleeding until the doctor transitioned to a full open procedure to find and stop the bleeding. My wife has permanent nerve damage, severe pain and continued intestinal and bowel issues. All of which, she did not have until this surgery. Do you think this doctor is liable? I believe that the doctor resorted to a hysterectomy when he was unable to explain what is wrong with my wife. After the procedure and our concerns over the complications he stopped post-op care and transferred my wife to another doctor.
