Legal Question in Military Law in South Carolina

awol- can you find a list

i have a friend who went awol and has decided not to go back unless he sees his name on the list then hes goin back he went in Aug 17 and went awol feb3 of this year he wasnt in 180 days but the local court system doesnt have a list of names and i know that fort knox does but we have looked for it and cant find it. is a federal warrent out for his arrest? can you please help with any information.

Normally a Federal warrant does not get issued until the individual is placed into deserter status--about 30 days after the initial AWOL. It must be added that there is exposure to considerably greater jail time with a charge of desertion versus a charge of AWOL.

When a servicemember goes AWOL, the military documents and keeps track of that fact. After he has been gone for 30 days, then he is administratively declared a deserter and a warrant is filed against him. There is no list which is available to the public, but there are records showing who is AWOL. One a warrant is issued, it will be in the nationwide computer system so that if he gets pulled over for a speeding ticket, he could and likely would be arrested and returned to the military for punishment. The military usually will not go out and actively look fro him, but will send a letter to his home of record stating that he has been a declared a deserter and that he should return.
