Legal Question in Military Law in South Carolina

ucmj

I am in the army and deployed overseas. Me and a friend emailed the congressman asking about what steps to take to get a slot to Ranger school when we come home off deployment. Our direct chain of command was not helping us which lead to us emailing the congressman. The platoon leader found out about it and we are being punished. What does the UCMJ state about writing our congressman?

Re: ucmj

It is illegal to punish you for contacting your congressman.

You could file an article 138 (official complaint) against your command but this will likely antagonize them further.

Another problem is that many commands use other pretexts to punish a soldier. In other words, they might smoke you for something else, or they might give you a counseling statement or an article 15 for something unrelated as retaliation.

There's a lot of crap they can pull so you have to decide how much crap you can deal with and how hard you want to fight it.

Good luck. It sounds like you have a fight ahead of you.
