Legal Question in Personal Injury in South Carolina

I accompanied my mother to her doctor's appointment. It was raining that day and the tile inside of the entrance was wet and I didn't notice it until I slipped and broke my arm. They did not have a wet floor sign or any carpet present. Since the incident, I have a very noticable scar on my arm which cut down on some of the jobs I used to get prior to the fall (I'm a model), not to mention the jobs I had to cancel because of recovery (my arm was in a cast). On top of that, the man I was engaged to called off our engagement because of the scar. My questions are: Can I sue? If so, Who can I sue?

To answer your question, yes you can. Your case is called a Slip & Fall. A lot of Slip & Falls are looked down upon as so many of them are nearly frivolous. Yours however is not. From what you described, you have a good case. A Slip & Fall is a type of a Personal Injury, which falls into the negligence category of the law. Under the negligence laws, there are two major requirements. One, is there must be Liability. That means that you must be able to prove that someone is liable for your injuries. From what you have explained, it appears that there is clearly liability. The second requirement is Damages. This amounts to in your case your injuries. Again, you clearly have damages since you were obviously seriously injured. So to summarize, you have the requirements of a good negligence case.

As far as who to sue, that is part of what an attorney does, is investigate to see who could be held liable. It all depends on a number of different factors, such as who owns the building, who maintains the building, whether it was rented or not, whether there is a property manager or not, whether the offices are shared by other doctors, and so on. Along with that we also investigate to see what insurance coverage is available.
