Legal Question in Personal Injury in South Carolina

contract, realestate, fraud??

We looked at a house for sale (no realtor). It is parents house. The father is deseased. The son, care taker & POA (of 14 months) showed it to us. Next day we offered to buy home for asking price (85k) We gave his atty. ernest money and his attorney drew up contract. His attorney also signed witnessed poa. The ernest check cleared bank. Son (POA) called 2 weeks before closing and said he was sorry but his sister wants house and that he would be in touch. He offered $400, $1000 and then said on voice mail he would give $5000 and for us to accept or he would not close. He then interfeered with inspection and appraisal. He then said he was going through with it. He allowed appraisal (105k) and termite insp. Then 2 days before closing, our closing atty. called off closing and said the sister filed a lis pendens on house and that she was challenging the validity of POA. Closing date was 3-31-07

We filed a lis pendens thru another attorney and he called last week and said he was dropping case due to a conflict of interest. The next day we were served with copy of a summons and are named on it. We dont know what our rights are or who to see.
