Legal Question in Personal Injury in South Carolina

My daughter fell at McDonald's and broke her arm yesterday (November 15th).She fell trying to get down the steps. I didn't tell the staff because it was the last thing on my mind at the time. Our insurance covered the bills 100% but I'm unsure if we should take legal action anyway. Any advice is appreciated. Thanks, Tracie Hall
