Legal Question in Personal Injury in South Carolina
Hello. This is in regards to an incident that happened on january 3rd at the olive garden in Columbia SC. My wife and I were dining at this establishment that evening when my wife was injured. She ordered the grilled shrimp capresse, when she bit into a shrimp, a piece of the wooden skewer which was supposed to be removed pierced the roof of her mouth. About 3mm of the skewer entered her palette. An accident report was filed, but liberty mutual, on behalf of darden restaurants, has yet to contact us. I did speak to the manager today and contacted them again and was told that I would receive a call Tuesday. My wife's injury had some complications, not to mention it was traumatic for both of us, so we are seeking a monetary settlement. Do you think we have a case? Is it worth pursuing or should we just accept the claims they offer?

Hi:
You asked if you have a case and if its worth pursuing or if you should just accept the "claims they offer."
I have handed a number of food cases over the years. It possible that its worth pursuing, but I need a little more information. I would suggest calling me. I don't charge people just to talk. I need to ask a few questions. Most important is what sort of medical treatment she has had and how much its cost so far. And, of course, I'd like to know if the injury will heal okay or not.
My office is in Horry County, but I take cases all over the state, including Columbia.
