Legal Question in Personal Injury in South Carolina

I was involved in a fight where the other individual attacked me and struck me in the face and we began to exchange blows. I ended up breaking his jaw, and they are now pressing charges against me. It happened at a party where he was not invited too, or welcomed and we were both intoxicated at the time. I was wondering what kind of trouble am I looking at?

Its hard to say what your facing without knowing more information. In South Carolina there are three different Assault and Battery charges and I do not know which one they charged you with. One is Simple Assault, the other is Assault and Battery of a High and Aggravated Nature and the third is Assault and Battery with Intent to Kill. The penalties for these three vary. The first is up to 30 days in jail, then ten years, then twenty years. I also need to know more about how the fight started to evaluate your chances of sucessfully asserting self defense. And of course knowing what sort of statements the witnesses gave and who would testify to what is important.

I'm a criminal defense attorney with a practice in the Myrtle Beach area. I also take cases from around the state. You are welcome to call if you would like to discuss this.
