Legal Question in Personal Injury in South Carolina

Minors rights who are involved in an auto accident.

My nephew was involved in an auto accident at 3 years of age. He was in a coma for approx. 2 months.He is 9 years old now, and his father tells me that the insurance settlement can only be touched by his attourney until he reaches age 18 at which time the child will undergo a psyciatric evaluation. His parents say they have no control in the settlement.Can this be correct?

That is probably true, and it would depend on the language of the Court Order approving the Settlement. The Courts don't want the child's money squandered before he becomes of age.
