Legal Question in Personal Injury in South Carolina

personal injury losses from motor vehicle accident (victim)

On January 3, I was injured in a near-fatal MVA. The lady at fault was killed (excessive speed, head on). I do not fully understand insurance claims. My insurance has covered 80% of all claims thus far. She had coverage, but now I am told that with her maximum coverage of $100,000 I will to repay my insurance carrier when we settle. I am not able to return to work, I can not drive presently, and am facing future surgeries. I was only 6 mos. from full retirement, my family health coverage and dental will be cancelled unless we pay the premium, they tell me there is no recovery for pain and suffering. We have an attorney and he is advising us to settle for the $100,000. Please advise. Thank you.

Unfortunately, as much as I would like to type in an answer to your questions, I'm not allowed to do so do to certain rules that prevent me from responding here to your question. Certain ethical rules forbid an attorney to consult with an individual that is already represente by an attorney.
