Legal Question in Personal Injury in South Carolina

Punitive damage awards against diabetic drivers causing auto accidents

Are there any South Carolina cases where the court has awarded punitive damages for personal injury sustained in an auto accident caused solely by a Type 1 diabetic driver and if so, what was the $ range of the award and standard of behavior necessary for the court to reach its holding?

Re: Punitive damage awards against diabetic drivers causing auto accidents

This question should go to a South Carolina attorney, not Florida. I would doubt that any jury would assess punitive damages against a diabetic driver solely because he was a diabetic. Punitive damages are only imposed for willfull or flagrant conduct. Most likely in drunk driving situations.
