Legal Question in Personal Injury in South Carolina

Purposly Rearended

While driving my car one day I lost my temper with the car that was tailgating me and purposely slamed on my brakes so that he would rearend me. Well in the so called axident i was injured, Broken leg and arm. My question is does it matter that I did it on purpose and am I entitled to any kind of settlement.

Personally, I hate people that tailgate. I think that it is one of the most ignorant things that a person can do on the road. How stupid can a person be to think that if they drive close to the person in front of them, that they will actully get to their destination sooner. But, as far as your question is concerned, yes, it does make a difference that you did it on purpose. I have never heard of an insurance policy that covers intentional acts. All policies that I've ever seen only protect you in the event of an "accident," which implies that no one did anything intentionally to cause it. As far as settlement, my answer is basically the same. To be absolutely sure though, consult your insurance policy. It would be a good idea to check with the other driver's insurance company to see what their position is. Although the law states that a person must drive at a safe distance from the car in front of them to allow them to slow down or stop in the event of an emergency, you did after all slam on the brakes, "so that he would rearend me." Therefore, I wouldn't get your hopes up. Good luck.
