Legal Question in Personal Injury in South Carolina

slip and fall injury

I slipped and fell in a hotel in Greenville, SC in April 2004 while working on company business. The hotel reimbursed me for approximately $1000 in therapy expenses. I signed a release. For the past several months I have had horrible pain in my right hip and leg. I was just told that I need a lumbar fusion. I no longer work for the same company. Do I have any recourse against my old company or the hotel?

Did you ever file for worker's compensation? Was your employer an Ohio company?

Since the accident occurred in SC, you may file a SC Workers' Compensation claim. SC Workers' Compensation law is considered more generous to Claimant's than most states. You would be entitled to payment of all medical treatment, weekly checks in the amount of 2/3 of your gross weekly pay while you are out of work, and a lump sum for any permanent impairment following the surgery or release by the doctor. Additionally, you may pursue a slip & fall claim against the Hotel and recover again for your medical treatment, lost wages, and pain and suffering. Let me know if I can be of further assistance.
