Legal Question in Personal Injury in South Carolina

Supeona rules

As a doctor how do I handle being supoena'd? I received a supoena today (friday) for Tuesday at 2:05 I have patients scheduled all day. I know the supoena's used to say I was to be given 2-3 weeks notice. What are the rules and guidelines?

I hate to tell you this, but physicians are just like everyone else. You must obey the subpoena or file a motion to quash the subpoena. That's the way the rules work.

The other approach would be to call the attorney who had you served and see what can be worked out. He or she does not want you waiting all day to testify. Maybe he could tell you the specific time you would be needed to testify. Sounds like a phone call from you to the attorney would solve much of your problem. Is it possible that you have not taken the time to speake with him? Many times a subpoena is the only remedy for people who are difficult to deal with.

I would need to ask you some questions about the specific subpoena that you recieved. Right now, I don't know if your are a retained expert, lay witness, party/non-party to the case, etc. I also don' know if its state court, federal court, etc. Since its Friday and my office is closed until Tuesday and I will not be there to look up any of the rules, I would be happy to speak with you if you would like to call my cell phone over the weekend.
