Legal Question in Product Liability in South Carolina

Golf course accident

This sun. I was on the 10th hole of a golf course and hit my ball in the water. I parked the cart and walked over to see if I could find my ball when all of a sudden the cart came rolling by and crashed into the pond. I know i put the brake on because we both got out and selected a club from our bags. And obviously we could not do that from a rolling cart. We assume the brake popped which caused the cart to roll into the pond. Now the course is holding me responsible for the cart. I never signed anything nor did they explain anything about cart responsibility they said it should just be known. I still say that it was a defective cart. Am I going to be held responsible?? Please help.

You are not automatically responsible simply because someone says you are. They could always file a law suit againt you. I would have to wonder however if that is a realistic thing for them to do. You may want to call the manager and talk with them. Its possilbe that they have insurance that will cover this. You may also want to have your friend do an affidavit saying that you put the brake on. As with all legal matters, I suggest you consult with an attorney prior to doing anything. Good luck
