Are we entitled to our money invested in a halted home purchase?

My husband and I were supposed to close on a home yesterday. We found out hours before closing that we could not go through with it b/c two brothers were fighting over the house and it couldn't be sold. The selling agenty knew all along and didn't say anything, instead tried to pressue the attorney to close anyway. I know we are entitled to our earnest money, but what about our appraisal fees and other required expenses that we incurred under the impression that the house was going to be ours.
