Water damage

Must my neighbor be proven negligent for her to be responsible for her overflowing toilet and resulting damages to my condo below hers?

Yes. Otherwise a person could simply point their finger at someone, and that wouldn't be fair. Anytime you want to hold someone liable for something, then you have to prove it. I hope I answered your question. I'm not entirely sure that I understood it.
