Legal Question in Sexual Harassment in South Carolina
alleged juvenile sexual assualt
My son, 16, has been accused of grabbing a girl's butt at school, and the school resource officer has turned the incident report over to DJJ with a recommendation that he be charged with sexual assault. When I asked what evidence they had she would not give me any other information. No formal charges have been filed yet, but is there a way for me to find out what evidence is warranting such action, when all they supposedly have is her word against his?

I am sure this is a very upsetting time for you and your son. It's imperative that you seek legal counsel for your son soon. If charges are brought, at that time you will be entitled to all evidence in DJJ's possession. Prior to that point, there isn't much that can be done apart from an appeal to the school authorities.
