Legal Question in Traffic Law in South Carolina
Do i have a Chance if i plead NG??
I was in a Single Vehicle Accident. I was driving a Day Cab International Hauling a 43 Foot Tanker Trailer. I was inside the plant and doing approx. 10 Miles a hour ( i do have 2 witnesses but they will not put it in writing). As i was making a right hand turn the tanker seemed to skid or the breaks locked up ( I was not touching the breaks at the time). I was nearly straight and i have pictures of the truck after it was picked up and it can be clearly seen that the trailer was nearly straight (approx 170 degree angle).
My question is with just using the pictures as evidence do you think i may have a chance if i plead not guilty??
Also on the ticket i noticed the officer put my driving class as D when i have a Class A. Could i use this a last resort to get the ticket thrown out??

Re: Do i have a Chance if i plead NG??
It sure would have been nice if you had mentioned what you got a ticket for. Its a little hard to give you a prediction on beating a charge, if I don't know what the charge is. I will tell you two things however. You cannot get a ticket thrown out due to something like it saying "D" when it should have said "A." That pretty much only works on television. The officer can simply amend the ticket. Plus it has no bearing on whether you are guilty of the charge, whatever that charge might be. Secondly, you ask if you have a chance with the pictures if you plead Not Guilty. That's a little confusing. I assume your asking if the pictures are sufficient to win a trial? Again, I don't know what your charge is. I'll tell you something that might help though. Predicting whether a person will win or lose, is pretty much based something that non-lawyers can often predict themselves. After all, it is non-lawyers that are the jurors at trail. These are every day folks who listen to the testimony and consider the evidence in making their decision. Therefore, you can ask yourself, how would you decide if you were on the jury and considered the evidence and testimony. If I knew more about the charge I would tell you more, but this is the best I can do with the limited information you provided. You are welcome to call if you would like to talk about it. Good luck.
