Its hard to say what your facing. DUS First and Second Offense carries possible jail and a fine. However, usually they only make the person pay a fine and they do not put them in jail. Third Offense and more have mandatory jail sentences of at least 90 days. Often as an attorney we can get them to reduce a Third Offense to a Second to keep the person out of jail. Its also possible to do that with a Fourth Offense too, but its harder. It depends on the particular solicitor, police officer, judge, the defendant's driving record, how old the previous DUS was, etc. As a criminal defense attorney I always make them produce the Notice of Suspension that was mailed to the defendant and is required by law.
