Legal Question in Traffic Law in South Carolina

should my insurance have to pay?

A week ago, my husband was stopped at a stoplight, removed his foot from the brake too soon and tapped the lady's vehicle in front of him. They both got out, and assesed that there was no damage. My husband offered to call the police and she said that wasn't necessary, that they could just exchange insurance info. My naieve husband settled for that, and she has now reported the accident to our insurance company. Our insurance co. assessed her vehicle, and informed them that there was no damage. Only after the insurance co. informed them of this, did she now, a week later, start complaining that her back is hurting.

If there is no police report, and no vehicle damage, should we have to pay this claim of her back hurting, from a not even 5 mile an hour accident. How do we know that her back was not hurt before this accident?

Re: should my insurance have to pay?

Discuss it with your insurance company. It sounds like you are covered for any claims they might make.
