Legal Question in Traffic Law in South Carolina

Rule 5

Hi,

If I submit a Motion for Rule 5 to the solisitor's office for a speeding ticket, shouldn't I get the officer's home address and phone number.(I'm sure they won't give that up) After all the cop will be the prosecutions only witness and the defense must be allowed to interview any witness before trial in order to prepare a proper defense. If I don't get the information I requested, shouldn't my objection to the cop as a witness be upheld by the court. Jury trial will be in majistraite's court in greenville.

Re: Rule 5

The only contact information you will get is through where ever the police officer works. There is no rule that says you have the right to interview a witness. Its permissible to try, but they don't have to talk with you if they don't want to. Good luck.
