Legal Question in Traffic Law in South Carolina
Simple possession
I was recently pulled over on 95 south on my way to move to Fl from Pa, and I got pulled over for driving under the speed limit. I had a friend following me in my other vehicle, and they were stopped behind us for following to closley. Upon the stop, our vehicles were searched and marijauna was found, and so I was given a citation for simple possession. I was given 3 months to pay the fine which was $586.00, but being a mother of 3, and only having serving as a source of income, I live hand to mouth and could not save the money in time, nor could I afford to attend the court date to set up a payment arrangment. They told me I had 15 days to pay or there would be a bench warrant issued. I still do not have the entire amount, and I wanted to know what will happen if a bench warrant is issued? I am terribly worried, because I have a family to think about, and this all stems from the fact that the couple in my car following me to Fl was hiding the marijuana in their possession, but since it was my car, and I was with them, I was charged. I was just hoping for some insight on this, because I have never been in this situation before, and I do not know what to do. Thanks for your time.

Re: Simple possession
A bench warrant means that you could be picked up and found in contempt of court for not paying the fine. You need to contact the court, explain your situation and ask for an extention to pay the fine. You should also offer to pay whatever amount you can now. Good luck.
