Did my state commit a crime against me?
2005 January I was convicted of a marijuana offense simple possession. I get my permit about a month later from january. September or october I get my drivers license. 11-30-2006 my license was suspended from the marijuana charge. I recieved no letter and found out it was suspended when I was pulled over in a different state for speeding. According to www.scstatehouse.net the dmv wasn't supposed to even give me a license and should of told me to wait 6 months until I can get a license. Now I can't work because I don't have a license ''I drive all day for work''. They made a mistake by giving me a license in the first place. What can I do? Please help me.

Since I am not privy to all of the documentation as it relates to your case, I can only guess as to what happened. My guess is this: When you were convicted part of your sentence was for a 6 month suspension of your license. Since you were not licensed at the time of your conviction, there was no license to suspend. Then when you became licensed, which I agree with you that it was probably a mistake, they then invoked the suspension. You can contact the DMV at your local branch and speak with a supervisor and also contact the main office in Columbia. However, your facing two big obsticles. One, getting any personal attention from DMV is not likely as they are under-staffed and handle millions of matters a year. Secondly, even if you had legal recourse and I don't think you do, it would probably take so long to get it resolved that your suspension period would be up by the time you got the problem fixed. I would encourage you to consult with a lawyer in your county that practices Traffic Law. Good luck.
