Legal Question in Traffic Law in South Carolina
Ticket in SC for NC resident
Tonight I rec'd a speeding ticket for $350 ticket & 6 pts for driving 80mph in a 55mph zone. My wife and I were behind a SUV that was driving about 45-50mph. As soon a passing zone presented itself, I attempted to pass. While passing, the other driver began accelerating. I did too, visually seeing my guage reach 70 mph which afforded me enough distance to pass the car at a safe distance. Immediately after pulling back into into the lane, I slowed down under 60. Within minutes after, a police car passed the other car and pulled me other. The car I passed, turned off into what I assume was the owner's yard about 150 meters ahead. I explained to the officer that I only sped up because the other car sped up while I was in passing lane passing the car. The officer said that he clocked him at 60. My wife did not see how fast I was going, but did recognize the car we passed was driving less than the speed limit before I attempted to pass. What would be the best way to get this fine and the points reduced or even dismissed if possible? Thanks for any help.

You can hire an attorney or go yourself to the court date on the ticket and ask for a reduction. You also have the right to request a jury trial and ask for a reduction then.

I would imagine hiring a SC attorney and seeing if he or she can get it reduced to 64 in a 55 or a prayer for judgment.
